What is Mesothelioma?
Mesothelioma is a cancer with no known cure. It attacks the mesothelial cells in the body, which are found in tissues that cover the lungs and abdomen and most other internal organs, causing intense pain and discomfort.
The presence of cancer in these cells was first identified as far back as 1767 by French physician Joseph Lieutaud but was identified as a serious cancer connected to asbestos exposure by German scientist H.W Wedler in 1943. Unfortunately, due to the political instability of the era, few outside of Germany took notice, and it was medical researcher J.C. Wagner and physician Chris Sleggs who finally drew attention to the connection between asbestos and cancer of the mesothelial cells in a paper published in the British Journal of Medicine in 1960.
How is Mesothelioma dangerous?
The disease has a long latency period, meaning that it can develop many years after exposure to the materials that cause it. It is an aggressive disease that is considered fatal by medical experts, as there is no cure. In additional to being extremely painful and incurable, the disease is aggressive. Upon diagnosis, patients are expected to survive for around 12 months.
How Does Mesothelioma Occur?
Mesothelioma is caused by exposure to asbestos, where tiny airborne asbestos fibers are breathed into the body and become lodged within the lining of the lungs, abdomen or heart. Over time these fibers damage the mesothelial cells, causing inflammation which eventually lead to tumors forming on the damaged areas.
Who Qualifies for a Mesothelioma Lawsuit?
If you or a loved one have been exposed to asbestos and subsequently been diagnosed with Mesothelioma, you may be eligible for a Mesothelioma lawsuit.
The most common types of mesothelioma claims will either be considered personal injury cases or wrongful death cases. In each case, you will need to file before the three year statute of limitations expires. If you are filing a personal injury claim, the statute of limitations expires three years after diagnosis. If you are filing a wrongful death claim, the statute of limitations expires three years after the death of your loved one.
What Can You Recover for a Mesothelioma Lawsuit?
Mesothelioma is an expensive disease to treat, and a lawsuit would seek to recover the cost of medical bills associated with the cancer. Those who file a lawsuit and are awarded a settlement may recover the cost of the medical bills incurred during treatment. In addition, they may recover lost earnings from being unable to work, emotional damages, pain and suffering, and other financial costs that have been incurred.
For those filing on behalf of deceased loved ones, costs of funeral proceedings and additional damages may also be recovered.
