Are You Eligible to File a DePuy Hip Lawsuit in Arizona?

Even though Johnson & Johnson issued a recall for its DePuy hip implant models in 2010, many patients received implants after this date. These implants were highly dangerous, and there is evidence to suggest that Johnson & Johnson’s top executives knew it. As a result, following the DePuy hip implant recall, the company has faced a wave of lawsuits, including class action filings.

Are you eligible to file a DePuy hip lawsuit in Arizona? Or, can you join an existing class action against Johnson & Johnson? You may have a claim if:

  • You received a DePuy ASR hip implant;
  • You received your implant within the past 10 years; and,
  • You have had revision surgery as a result of your implant.

If you satisfy each of these three requirements, we strongly encourage you to speak with one of our nearby lawyers about your legal rights. If you don’t qualify (or aren’t sure if you qualify) and have questions about your legal rights, we are happy to discuss your options with you as well.

Risks Associated with Johnson & Johnson’s DePuy Hip Implants

The risks associated with Johnson & Johnson’s DePuy hip implants relate to the device’s design. While modern hip implants use a combination of materials to maximize their longevity, Johnson & Johnson’s DePuy hip implants were “metal-on-metal” devices. They involved implanting a metal cup into the pelvis and a metal stem into the femur, and then attaching a metal head to the femoral stem that articulated within the pelvic cup. During this articulation, the metal components of the device would rub together—causing metal particles to flake off into the body.

Over time, the presence of these metal particles in the body has led to serious complications for many patients. This includes complications such as:

  • Elevated levels of chromium and cobalt
  • Headaches, tinnitus, and other systemic medical conditions
  • Metallosis
  • Necrosis of the tissue surrounding the implant
  • Pseudotumor

As a result of these complications, many patients have been forced to undergo revision surgery. This is a second surgical procedure performed to address (or prevent) the complications caused by a defective implant. While some patients’ revision surgeries have been successful in reversing (or preventing) the harm caused by their defective DePuy hip implants, many implant recipients are now suffering from permanent consequences.

About the DePuy Hip Implant Recall

The U.S. Food and Drug Administration (FDA) classified the recall of Johnson & Johnson’s DePuy hip implants as a Class II recall. As the FDA explains, a Class II recall involves “a violative product [that] may cause temporary or medically reversible adverse health consequences or where the probability of serious adverse health consequences is remote.” But, while the risk of serious adverse health consequences may be remote, the large number of patients who received defective implants—approximately 93,000—means that there are still many cases of patients suffering debilitating and life-altering effects.
